San Antonio Man Indicted by Federal Grand Jury for Receipt and Possession of Child Pornography

John E. Murphy, Acting United States Attorney, and FBI Special Agent in Charge Ralph G. Diaz, San Antonio Division, announced that Gary Leland Dieterman of San Antonio was arrested this morning without incident based on a two-count indictment returned yesterday charging him with one count each of receipt and possession of child pornography.

The indictment alleges that in March 2008, Dieterman received via the Internet several images of a minor engaging in sexually explicit conduct. On September 22, 2008, FBI agents discovered the images on Dieterman’s computer subsequent to an executed search warrant at his residence.

Upon conviction, Dieterman faces between five and 20 years in federal prison on the receipt of child pornography charge and up to ten years in federal prison on the possession of child pornography charge. Dieterman remains in federal custody pending a detention hearing scheduled for 10:00am on Tuesday, June 23, 2009, before United States Magistrate Judge John Primomo.

This case was investigated by the Federal Bureau of Investigation and the Live Oak Police Department. Assistant United States Attorney Tracy Braun is prosecuting this case on behalf of the government.
